Supreme Court Begins Hearing on Constitutional Reference Case
The Supreme Court of Fiji today commenced the hearing of the historic constitutional reference case at the Old Parliament Complex, Veiuto. The case, filed by Cabinet through the Solicitor-General’s Office, seeks clarification on the interpretation of the amendment provisions of the 2013 Constitution, including the processes and thresholds required for constitutional change.
Representing the State, senior Australian barrister Bret Walker SC opened submissions, supported by the Solicitor-General. The Minister for Justice and Acting Attorney-General, attended proceedings to provide legal and political oversight on behalf of Cabinet, underscoring the Government’s commitment to the highest standards of accountability and transparency throughout the process.
The Court has invited a number of intervenors, including political parties, members of the opposition including Honorable Inia Seruiratu, civil society organisations such as the Fiji Law Society and the independent state institute of the Human Rights and Anti-Discrimination Commission, to present their views during the hearing.
The questions before the Court cover whether certain provisions of the Constitution are amendable, the thresholds and processes required for any amendment, and the continued legal status of the 1997 Constitution.
Hearings are scheduled to run from 18 to 22 August, with the Supreme Court expected to deliver its advisory opinion on 5 September 2025. Proceedings are being livestreamed to ensure public access to this landmark event.
