1. Request for New Certificate of Title

To request for new certificate of title, the following information is required:

 

  • Name, address, occupation of registered proprietor
  • Land details
  • Signed by the proprietor
  • Correct for the purposes of LTA to be signed

 

  1. Recent certified true copy of the Title
  2. Duplicate title
  3. Copy of the registered deposited plan
  4. Identification of applicant
  5. Registration fees $10.90 per lot (VIP)
2. Transfers

2.1 Transfer of CT’s (Freehold Land)

  1. Transfer document
  2. Duplicate Certificate of Title
  3. Stamp Duty Payable at FRCS
  4. Capital Gains Tax Clearance Certificate
  5. Valid Identification of all parties
  6. Consent of Minister for Lands if transfer is subject of Land Sales Act.

2.2 Transfers of Lease

  1. Transfer document

  3. Consent of either of the following authorities, iTLTB, Director of Lands, Housing Authority, Methodist Church Lease whichever is applicable.

2.3 Transfers by Mortgagee Sale

3. Mortgages

3.1 Mortgage

  1. Mortgage document
  • Name of the Mortgagor and the Mortgagee
  • Land details
  • Signed by Mortgagor/ and Mortgagee and witnessed
  • Correct for the purpose of LTA to be signed
  • Consent if applicable
  1. Stamp Duty Payable at FRCS
  2. Duplicate Title/Lease
  3. Valid Identification of the parties

3.2 Variation of Mortgage

  1. Variation document in duplicate
  2. Duplicate Title/Lease
  3. Duplicate copy of Mortgage
  4. Mortgage to be executed (executed and attested by a qualified witness)
  5. Valid identification of all parties
  6. Lodgment Fees $2.20 (VIP)

 

3.3 Discharge of Mortgage

4. Caveats

4.1 Caveat

  1. Caveat document
  • Caveator’s name, address, occupation
  • Caveatee’ s name, address, occupation
  • Land details
  • Address that is provided should be local address
  • Application should be signed by the caveator and witnessed
  • Correct for the purpose of LTA to be signed
  • Consent from Director of Lands if State Lease
  1. Evidence to be attached
  2. Recent certified true copy of the Title/Lease
  3. Valid Identification of the caveator
  4. Lodgment Fees $2.20 (VIP)

 

4.2 Removal of Caveat

  1. Removal of caveat document
  • Caveator’s name, address, occupation
  • Caveatee’ s name, address, occupation
  • Land details
  • Address that is provided should be local address. The caveators address should be the same as the caveat application address unless there is a change of address lodged and registered on the title/lease.
  • Application should be signed by the caveatee and witnessed
  • Correct for the purpose of LTA to be signed
  1. Copy of caveat document
  2. Valid Identification of the caveatee
  3. Lodgment Fees $2.20 (VIP)

 

4.3 Withdrawal of Caveat

  1. The withdrawal of caveat document must have:

 

  • Signed by caveator and witnessed
  • Caveat number that needs to be withdrawn
  • Land details
  • Valid Identification of caveator
  • Correct for the purpose of LTA to be signed

6. Leases

6.1 To register a Housing Authority sublease, following is required:

  • Leases are being properly executed by the Lessees and Lessors and witnessed by Solicitors
  • Diagram/Map of the Land

6.2 iTaukei Leases

 

To register iTaukei leases, the following is required:

 

  1. Lease in duplicate
  • Name of Lessors

  • Leases are being properly executed by the Lessees and Lessors and witnessed by Solicitors
  • Diagram/Map of the Land
  • Leases are being properly executed by the Lessees and the Lessors

6.3 State Leases

 

To register state leases, the following is required:

  1. Lease in Duplicate
  • Name of Lessors

  • Leases are being properly executed by the Lessees and Lessors and witnessed by Solicitors
  • Land Transfer Act Clause signed
  • Stamp duty payable at FRCS

6.4 Methodist Church Leases

 

To register a Methodist church lease, the following is required:

 

  1. Lease in duplicate
  • Name of Lessors
  • Name of Lessees
  • Land Descriptions – Ma/Diagram
  • Lease details
  • Leases are being properly executed by both parties and witnessed by Solicitors
  • Land Transfer Act Clause signed off
  • Stamp Duty payable at FRCS

Leasing of Freehold Land

 

To register lease on freehold land, the following is required:

 

  1. Lease in Duplicate
  • Names of Lessors
  • Names of Lessees
  • Land Description
  • Lease Details
  • Leases are being properly executed by both parties and witnessed by Solicitors
  • Land Transfer Act Clause signed
  • Stamp Duty payable at FRCS

7. Discharges

7.1 Discharge of Mortgage (Titles)

  1. Discharge of Mortgage document (to be executed and attested by a qualified witness)
  2. Duplicate Title/Lease
  3. Stamp Duty payable at FRCS
  4. Valid identification of all parties
  5. Registration Fees $2.20 (VIP)
8. Provisional Title/Lease
  1. Request for Provisional Title/Lease document
  2. Statutory Declaration signed by registered proprietor or any other person who has knowledge of the lost title
  3. Statutory Declaration is witnessed by a qualified witness specified under the Land Transfer Act 1971
  4. Recent certified true copy of title/lease
  5. Valid identification of all parties
  6. Lodgment Fees $10.90 (VIP)
  7. Once notice provided by Titles Office, notice to be advertised on the newspaper and gazette. After the 14 days period, newspaper and gazette cuttings to be submitted to Titles Office.
9. Partial / Partition Transfer
    1. Partial/ Partition transfer document
    • Details of the transferor
    • Details of the transferee
    • Land details
    • Signed by the transferor and witnessed
    • Correct for the purposes of LTA to be signed
    1. Recent certified true copy of the Title
    2. Copy of the registered deposited plan
    3. Duplicate Titles (only in cases of 1st partial / partition transfer over the title; thereafter the duplicate is retained by Titles Office)
    4. ID of the transferee
    5. Stamp duty payable at FRCS
    6. Capital Gains Tax certificate to be attached
    7. Lodgment Fees $10.90 (VIP)  + transfer fee based on consideration amount

10.2 Court Order

  2. Receive plans from Registered Surveyors
  3. Plans to be approved by Director of Town and Country Planning (DTCP)

  5. Lodgment Fee – $1.10 per Lot and $32.70 per plan (VIP)
12. Vesting Order
  1. Vesting Order application in duplicate
  2. Signed by the parties and witnesses by the Solicitor or Commission of Oaths
